The facts as related were placed before the Bench, the police adding that the defendant was slightly under the influence of liquor at the time. The Bench said they had considered the evidence but were not satisfied that there was anything to show that the defendant intended to steal the goods. They pointed out that it was quite a common practice for people to pick up articles in one part of a shop and put them down in another. Further. defendant had not left the shop before being approached.
