CLAIM AGAINST A FARMER. SUPREME COURT JUDGMENT. Air Justice Adams to-day gave his decision in a claim by the New Zealand Loan and Alercantile Agency Company against Robert Al’llhinney, of Fairfield, near Ashburton, a claim for £BOO on account of sheep short credited and short delivered in 1918. His Honor said that defendant was entitled to receive credit for £136 12s 8d and £165 4s in respect to the first and third items in dispute, but was not entitled to anything in respect to the second item, a claim for £lB7 10s for 100 ewes alleged to be short delivery. In regard to that item, when it became necessary to remove tho ewes from Air Haugh’s land, and at every subsequent stage, defendant was informed, and his instructions were sought, and there was nothing to show' that the company’s local agent failed to do the best he could in defendant’s interests. The account in respect to the second item must be adjusted, on that basis, with other adjustments agreed on before the hearing. "When that had been done plaintiff would be entitled to judgment for the final balance shown to be due.
