Detective Lean state.i that he had found £6O on the accused when he had searched him at the j>o lice station. His Honor (Mr Justice Sim) said that the witness had not given his evidence in sequence. He had got :t mixed up. “ Did you search the accused before you arrested him?” The witness admitted that he had searched Christie before he had arrested him. What business had you to search this man if you Fad not arrested him ?” said ' his Honor. Detective Lean : ‘‘ There were some suspicious circumstances.” His Honor: c * Well if you find a man under suspicious circumstances, are you entitled to search him?” Detective Lean : ‘‘The accused did not object.’’ His Honor: What choice had he. You ard Detective Sneddon grabbed him and overhauled bis pockets.’’ The hearing was proceeded with. .Inst previous to this little brush-up bis Honor bad refused to permit the Crown to trv to establish the identity of the accused by means of a piece of paper found in bis pocket, and which it was alleged was part af a tag from u key belonging to-the Otago Farmers Co-operative Association. His Honor said that it was absurd for the Crown to endeavour to establish the identitv of the accused by means* of■» such n piece of paper.
