SUPREME COURT ACTION. IT i - Honor Mr Justice Adams, in the Supreme Court in Christchurch to-day. dealt, -with a Timaru case, Alexander John Archibald v. Washer and Com* puny and William Edward Ivinnerney. Plaint iff. in January last, agreed to I it l on hire to Georg© Curson a fivesoater motor-car valued at £l4O, on terms. Curson, after paying some instalments on the ear. delivered it to Washer and Co., and instructed them to sell it by auction. ]t was bought by Kmnerney for £BO. and he took ;t away. The present action was for damages for conversion of the car. For the defence it was contended that the car really was sold to Cureon, and that the transaction was not a hire-pur-chase. His Honor said that Curson had not bought the car within sub-section 2 of .section 27 of the Sale of Goods Act. Plaintiff was willing to accept- re-deliv-ory of the car in lieu of damages. Counsel detired that the question of coats should be discussed before judg ment was entered. His Honor said that he would not give judgment in the meantime. If the parties did not arrange an amicable settlement, he would direct entry of the proper judgment, on the application of plaintiff. Mr M. J. Gresson appeared for plaintiff and Mr A. T. Donnelly for defendant.
