SALE OF BASILS.

CLAIM AND COUNTERCLAIM. The hearing of a claim brought by R.. Arlow and Co., exporters, Wellington, against H. O. Lane and Co., tanners and leather merchants, Wellington, was continued in the Supreme Court to-day before his Honor Mr Justice Adams. The hearing was begun on February 24. The claim originally was mainly for damages for breach of contract to soil basils. Plaintiffs contended that basils delivered to them were not up to sample, and that there was a shortage in one shiument. A claim by them for £2OO general damages for injuries to their reputation with their principals in America, on account of basils being of inferior grade, was abandoned, leaving the sum claimed, £253 10s 9d. The defence was that the basils delivered complied with the contract. Defendants counter-claimed for £2lO damages for plaintiffs’ alleged refusal to take delivery of some of the basils ordered by plaintiffs. Mr A. B. Sievwright. vritli him; Mr C. S. Thomas, appeared for plaintiffs, and Mr O. T. -T. Alpers, with him Mr R. E. Cuthbert. for defendant*.

Richard H. F. Arlow, manager of the Christchurch branch of R. Arlow and Co., said that he reported a shortage of ten bundles of basils, and Air Lane suggested that a claim should he made against the Union Steamship' Company. E. J. Arlow, recoiled by Air Sievwright.said that thirty-five dozen parcels were returned to plaintiffs from New York. (Proceeding.)
