MOTOR ACCIDENT.
CLAIM FOR DAMAGES. The hearing of a claim for £199 16s special damages, and £5Ol general damages in respect to a motor accident on April 7 near the corner of St Albans Lane and Papanui Road, was continued in the Supremo Court yesterday before his Honor Mr Justic Herdman and a jury of twelve. 'William Milner, salesman, Christchurch, sued Christina Mabel Blake, Waikari, driver of the car, Leslie Blake, her husband, who was joined as being responsible for damages caused by his wife, and John Hughie, her father, who was joined as the owner of the car, it being alleged that Mrs Blake legally was his 1 agent. Mr O. T- J. AlperH. with him Mr G. T. Weston, appeared for plaintiff, Mr M. J. Gresson for Mrs Blake and her husband and Mr C. S. Thomas "V>r Hughie. Plaintiff was cycling out of St Albans Lane into Papanui Road and alleged that Mrs Blake, through negligence, ran into him. He claimed £l9O 16s special damages and £5Ol general damages. The jury retired at 2.4,5 p.m., in- j spected the scene of the accident, and I returned at 4.55 p.m. The foreman j said that it had decided that Hughie j was not responsible- The verdict was i against Mr and Mrs Blake. The dam- j ages awarded were;—Special damages, { £199 10s less any compensation plaint- ! iff might receive from insurance; gen- ! e-ral damages, £IOO. His Honor said that he could not ac- j cept a verdict making deduction on ac- f caunt of compensation. That point had 1 not entered into the case. The jury, at his Honor’s direction, retired again for a few minutes, and awarded special damgeas £199 16s without reservation, and general damages £SO, a total of £249 10s. Mr Alpers said that he would like to consider the case for a few days before moving for judgment, as he wished to go into plaintiff’s position under the Workers’ vlorapensation Act, and his right to claim under the Act. His Honor gave judgment in regard to Hughie and deferred judgment in respect to Mrs Rleke and her husband.
