1 GIIOVE v. UNION STEAM SHIP CO. [Peii Press Association.] 'n r July 16. ihe Court of Appeal gave judgment his morning m the case of Grove y. ~ 111011 Sinp Conmany. TJio Court decided in favour of plaintiff in that the defendant company was not entitled to treat the course taken by a ship as fulfilling an obligation to perform the voyage from Vancouver to Auckland; and defendant, having elected to go to Sydney without landing the ship s cargo at Auckland was responsible lor the loss incurred b’v tho shipper.
