ST MARTINS TRAMWAY.

OBJECTIONS TO THE ROLL

A special sitting of the Magistrate's Court was held this morning before Mr H. W. Bishop. S.M., to hear objections to the roll of the St Martins tramway special rating area. The objections were heard under the regulations provided bv the Tramways Act and the Local Bodies Loans Act. Mr Anthony appeared for the Christ-church Tramwav Board.

John Warlow, of York Street, Opawa, objected to his inclusion on the ground that his property would not bo benefited. He was better served by the existing tramway. The application was dismissed.

Annie M'Phail stated that her objections were based on the same grounds as those of the previous objector.

The Magistrate stated that he could nor out a single section out of a whole area. It would not bo fair to the rest. The application would be dismissed.

.John Edwin Garland, for whom Mr Harper appeared, applied for exemption. He stated thai, his land consisted of fifty acres, which were used for sheep grazing. The nearest distance of his proixrty from the proposed tramway was about three-quarters of a mile. It was about the same distance from the existing tramway. The new tramway would not increase the value of his property. The Magistrate decided to uphold the objection, and exclude the petitioner from tho special rating area. Rosa Townend, for whom Mr Gresson appeared, objected vo being included in the area. Mr Gresson submitted that the fact that the St Martin's tramway would be two minutes nearer to the property than the present tramway would not increase the value of the property. The property consisted of three acres.

The Magistrate stated that he could not imhold the obiection.

The applications ol Sidney Mary Bowron and .Tohn 3'Tinders Scott (Mr Gressonl were dismissed. Henry Robinson claimed exemption from the area. Mr G. M Inlyre was instructed to report as 10 whether the property -would be- sufficiently increased in value by th" proposed tramway to warrant its included in the special area. The ease was adjourned until Saturday.
