Colonel dv Paty de dam informed the Court of Cassation that he had prepared a summary of the secret documents communicated to the court-martial ten years ago behind Captain Dreyfus's back. M. Baudoin, Procurator-General, demanded the production of the summary, which was understood to contain marginal notes. Colonel da Paty de Clam asked for delay, in order to obtain General Mercier's consent. M. Baudoin threatened to prosecute both for detaining State document^ and the summary was then produced. (The reasons given for a revision of the. 1894 trial of Captain Dreyfus and by a new court-martial were the communication to the Judges of documents not communicated to the defence, the contradiction between the experts of '94 and those of the Esterhazy trial as to the authorship of the bordereau, and the proof that Esterhazy ' used paper identical with that of the bordereau. 'Colonel dv Paty de Clam was arrested in consequence of the charges made against him in the proceedings before the Court of Cassation. He was charged with forging telegrams, disclosing documents in the secret dossier, and with improper conduct in the Esterhazy trial. .Colonel dv Paty de Clam was released a month later, and it was thus inferred that his explanation — that he bad acted under the instructions of Generals Gonse and de Boisdeffre— had been accepted.)
