Wednesday, .Oct. 7. (Before his Honor Ivir Justice Denniston.) His Honor sat in Chambers at 10 a.m. ORR AND ANOTHER V. STARK AND OTHERS. Mr Bishop appeared for the plaintiffs in connection with the return to an originating summons in this matter, a question of administration. Mr Hunt appeared for the defendant, William Stark, and Mr M'Connel for the infant defendant. After argument the matter was referred to the Registrar to ascertain who are the nephews and nieces of the testator, and whether Alexander Stark, the testator's brother, was alive or not at the time of the testator's decease. PROBATES. His Honor granted probate of the will of H. W.. Dv Moulin (Mr Scott).; Anah Lewis (Mr Bruges). • MILES AND CO. V. UNION BANK. Mr Breges asked that the applications for interrogatories in the cross-actions of Miles and C°- v- the Union"Bank and the Union Bank v. Miles and Co. might be allowed: to stand over, as Mr Fisher, who represented the other side, had not returned. His Honor said he would take the motions next day.
