Friday, Mat 15. (Before Mr S. Coleman, J.P., Mr A.Greig, J.P., Mr J. Innes, J.P,, and Mr W. S. Smith, J.P.) Breach of the Railway Act. — Edwin Tobin was fined ,£1 and costs for- crossing the railway line with horse and cart within view of an approaching train at Amberley. Alleged Breach of the Fencing Act, 1895.— W. H. Burton _ charged Archibald Earshmau with leaving open a swing gate on April 7 and 25 at Hurunui, contrary to Section 26 of the Fencing Act, 1895. Mr Stringer appeared for complainant and Mr Weston for accused. The offence of leaving the swing gate open was proved, but as complainant had no,t fully complied with the Act in providing notice boards on each side of the gate, as specified in the ordinance, the case was dismissed, each party to pay its own costs. Alleged Damaging a Fence. — W. H. Burton charged Archibald Earshman with wilfully damaging a wire fence, the property of complainant, at Mount Bangor on Nov. 1. Mr Stringer appeared for complainant and Mr T. S. Weston for accused. Owing to the absence of a material witness, the information was withdrawn to enable a fresh summons to be issued ; solicitors' and court fees to be paid by complainant. Assault. — George Landers was charged with as3a\ilting a little boy, J. W. Mason, at a football match at Amborley on April 30, and having pleaded guilty and apologised, was fined 10s and costs 7s. * Civil Case, — J. Rollinson v. Thomas Lascelles, claim Jill 7s 6d for work done. Defendant claimed a set-off, .£l6 103 4d, for board and lodging. Mr Stringer appeared for defendant. 'Judgment was given for plaintiff for £o and defendant for .£l6 10s 4d.
