Tuesday, Feb. 25. (Before Mr R. Westenra, J.P. and Mr . W. H. Hargreaves, J.P.) . Drunkenness.— A, man,- a first offender, was- ; nhed 5s and costs, in default twentyfoiij* hours' imprisonment: . Assault.— Mary Kemp was charged with having on Feb. 21, on Cambridge Terrace, assaulted Alfred Smith, by striking him on the face with her fist. Mr Weston appeared for the complainant and Mr Johnston for the defendant, who pleaded not guilty. After hearing evidence their Worships held that an assault had been committed without any provocation on tne part of the complainant, and the defendant was fined 5s and costs £1 14s. .. (Before Mr R. Beetham, S.M.) Civil Cases. — Judgment was given for plaintiffs by default with costs in the following cases *.— D. S. Bowman v. J. Robinson, claim £36 19s ; City Council v. Sarah Taylor, £5 4s 6d ; same v. William Johnston, £5 7s 3d; Church Property Trustees v. R. Ewing, £2 os ; same v. J. Williams, 6s 7d • Ashby, "Bergh and Co. v. W. Pickford, £5 3s 3d; same v. R. Reynolds, £3 5s 3d;, same v. P. D. Heardman, £5 158 8d ; same v. E. Spur, £2 16.— Mrs Macdonald Cox v. H. M'Call, claim £2 2s on judgment summons. The debtor did not appear, and an order was made for the payment of the sum, in default one week's imprisonment. — G. Hamill v. J. Trott, claim £62 16s commission on the sale of a farm. Mr Bruges appeared for the plaintiff and Mr Stringer for the defendant. It was admitted by the defence that the plaintiff had effected a sale of the farm at £30 per acre ; which sale would have been carried out but for the purchasing clause inthe lease from defendant to his son-in-law. It was contended that the plaintiff, before making . the sale, should have made enquiries as to whether /there was a purchasing clause in the lease, apaA . that he had been requested to do so. " After hearing the evidence, his Worship gave judgment for the defendant, with costs £3 14s.
