A Maintenance Case.
[Per Press Association.! AUCKLAND, Oct. 3. This morning at the Police Court an ; application came before Dr Giles, E.M., brought by Mrs Cole to estreat the recognisance of her husband, Philip Tennyson Cole (the well-known artist whose domestic troubles were some time -ago before the Auckland Law Court) and W. ■ J. Napier to pay JBI per week to the Clerk of the Court at Auckland for her support. The application waß opposed by Mr Napier on the ground that Mrs Cole was no longer in the Colony, and no proof was tendered that the money had not been paid. Mr M'Alister, for Mrs Cole, submitted that it was immaterial whether Mrs Cole waß in New Zealand or not. The order was to pay to the Cleric of the Court at Auckland, and if otherwise it was defendant's duty to prove. Dr Giles upheld Mr M'Alister's contention, and eaid it looked as if the absence of the wife was expressly provided for. Mr Napier asked for an adjournment for a fortnight with a view to a settlement. Mr M'Alister consented.
