THIS BAY. (Before His Honor Mr Jußtioe Denniston* and a Special Jury of four,) SEFTON V. WTAVT. Claim £100 for alleged libel. Mr Joynfc, instructed by Mr Deacon, for plaintiff. Mr Stringer for defendant. After discussion a clause making state* ments in mitigation of damages was strode out of the pleadings. Witnesses were ordered out of Court. Plaintiff's claim was for £100 for defamation of character contained in a state* ment made by the defendant on May 1, on a tram car, between New Brighton and Chrietchurch — "That Mr Sefton (the plaintiff) dared not show Mb face because he had flmbezzled £20 from the Foresters* Lodge." Both the parties were grocers at New Brighton. The defendant denied that at any time he used the alleged libellous ■words, or any words to the same effect. The Jury returned a verdict for the plaintiff for £2 damages. His Honor refused to certify for a special Jury.
