Monday, Oct. 6. (Before C. Hansen and J. L. Wilson, Esqs.) Poaching. — John Barnes, who waa charged with illegally having trout in his poasession.ldid not appear. Mr Spackman prosecuted on behalf of the Acclimatisation Society, Conbtable Burke deposed that he, in company with G. Wright, a ranger, caught the defendant coming down the South-west branch of the Waimakariri. He waited until the boat was brought to the shore, and then on examination found a bag with five nets, Borne two dozen and a half of herrings, one flounder and one troub ; also, three cauliflowers. The nets and trout were the same produced. The boat, which was pulled away directly Barnes landed, waa followed by Wright. Heard from Barnes that G. Newman was on board. The arrest was made about 3.15 a.m. The trout was caught in prohibited waters. 6. Wright gave corroborative evidence, and deposed to finding the boat tied up above the boatsheds ; no one was near it. Believed the boat was borrowed without the owner's consent. R. Dunn saw the offenders starting up the river on Sept. 29 ; they had a sack with them in the boat. He identified one of the nets produced as his property. It was stolen out of his garden, where it waa used to cover peas, about a fortnight ago. The parties who took it came for it in their stocking feet. This concluded the case. Mr Spacktnan said he would ask the Bench to issue warrants for the arrest of both Barnes and Newman, the net claimed by Mr Dunn to bo returned to him and the others confiscated. The Bench agreed with Mr Spauktnau, and orders were made accordingly. Civil Cases. — W. H. Ovenden v. W. Puddle, judgment summons, claim £11 13 a; order made to pay 10d per week, or one month's imprisonment. — In the following cases judgment w«s given by default: — W. H. Ovenden v. F. W. Orchard, £<h and costs. The Bame v. P. Teague, 4s Gd and costs. Thurlow v. Wilson, 6s (5d and costs. The same v. Mrs Friday, £2 0* Id and costs.
