LYTTELTON.
This Day. (Before John Ollivier, Esq., R.M.) CiriLCASKS.— Catherine Herbert v. Jacob Guidall, claim £2 ss, cash lent. Judgment by default for amount, and costs 7s Gd.— Joseph Conley v. John Vidulich, claim £2, for rent. Mr Joyce for plaintiff. Defendant said he had paid an amount of -21 10s to Mr Joyce's clerk. This was to settle the account, which was for rent to about Dec. 20, 1884. He (witness) had a receipt for the amount. On production, the receipt proved to be simply the account for the rent. Witness here stated that his mate saw him pay the amount. Thomas Kundaon, called, said he saw Vidulich pay an amount of J6l 10s to Mr Joyce's clerk. It was paid in the garden of witness' cottage. It was paid partly by a half sovereign ; ho could not say what the remainder was in. Mr Joyce's clerk consented to take £1 10s to square the account. Mr Joyce said that though his clerk had no recollection of receiving the amount, he would take judgment for 10s and costs. Judgment was then given for 103, and 7s costs. _______ _______
