♦ THIS DAY. (Before His Honor Judge Ward.) FANNY E. COCHRANE V. J. HENDERSON. Mr Joynt withdrew his withdrawal of motion for a new trial herein. Hi 3 Honor said that no doubt the plaintiff was entitled to have the point of her icontributory negligence decided by a jury. He would therefore make the rule absolute for a new trial, costs to abide the result. Mr Joynt said it would be impossible for him to attend in January, and would like an adjournment till March. Mr We3ton would like the new trial to be in February. His Honor fixed the trial for the February sittings, when the case Fanny S. Cochrane, against the same defendant, will also be tried. NATIONAL, MORTGAGE AND AGENCY COMPANY OF NEW ZEALAND T. GEORGE KING. I This was an action to recover .£144 5s 9d, amount due on an indemnity against a debt. Mr Joynt appeared for the plaintiff Company. Mr Meares appeared for the defendant, and consented to a verdict for the amount claimed. His Honor gave judgment for ,£144. 5s 9d, with costs. J. H. HOPKINS V. CHRISTCHURCH DISTRICT DRAINAGE BOARD. This was an appeal from a rate struck by the Drainage Board for the town district of Woolston. Mr Joynt appeared for the plaintiff. Mr Meaxes appeared for the defendants, and asked for .an adjournment till two o'clock, as Mi* Fisher was unable to attend, having been confined to his bed till this morning. His Honor adjourned the case till 12 o'clock sharp. At noon, Mr Fisher was in attendance, and, with Mr Mearc3, appeared for the respondent Company. Mr Joynt opened the case, contending that the rate should be in accordance with the expenditure incurred, and that it was excessive. (Left sitting.)
