The cook of the Loch Fergus, Banks, who was struck with a handspkie by an apprentice iv a quarrel on Sunday, died in the Hospital last night, never having recovered consciousness.

M'Ardle, Mr Mansford, R.M., gave judgmont this morning as follows : — lt was an undisputed fact that tho small bono of plaintiff's leg was broken on Sunday, Jan. 26, and that the fracture was occasioned through a disturbance in defendant's licensed houso. He had in a recent case expressed his opinion that the landlord of a public-house was justified in turning out any person making a disturbance or conducting himself in a disorderly manner, but that no more forco must bo used than was necessary to accomplish the end desired to bo attained. That plaintiff was conducting himself in a disorderly manner could not be doubted ; tho que-tion thon aroso, did defendant übo more forco than was necessary, and was tho accident tho result of that unnecessary force ? His Worship expressed the opinion that defendant acted improperly in allowing plaintiff to be drinking iv his house on Sunday, and that defendant used moro violence in ejecting plaintiff from his premises than was necessary. March 27.

Tho Emerald and Wolverine arrived during the night with the Governor, who will land at 10.30 to-day. The City and shipping ore nil dressed with flags, and the day is fine.
