CHRISTCHURCH. This Day. (Before C. C. Bowen, Esq , R.M.) Drunkenness.— Selwyn Davies, for having been drunk whilst in charge of a licensed dray, wai, on the evidence of constable Eares, ordered to pay a fine of 10s. Cattle Trespass. — The following fines were imposed for breaches of the Cattle Trespass Ordinance:— Malcolm Duncan, one liorse at large in_ Armagh street, ss ; Charles Truckle, two horses at large in Latimer *quare, ss; Oliver Lawson, one horse at large "ii the East town belt, ss; K. England, one torse at large in Latimer square, si; Christian 1 'itford, one horse at large in Lichfield street, ns; John Tetley, one horse at large in Barhadoes street, ss; Thomaß Mason, one horse xt large in Latimer square, ss; Richard Mrunsden, one horse at large in the same nlace, ss; Benjamin Bulmer,one cow at large in Salisbury street, 5s ; John Oliver, four horses at large in Durham and Gloucester streets, 10s; Samuel Walker, four cows at l.rgeon the North Road, ss; T. B. Tomb?, •me cow at large on the Papanui Road, ss. Absent from his Cab. — Thomas McKay was summoned for having absented himself from his licensed cab whilst in Madras street. « 'on stable Conway proved to seeing the horse urazisg on the side of the road fully ten minutes without accused being near it. Accused, in defence, said he was not more than ten yards away from the horse, on business, nd he had full command over the animal, which was known to be the quietest one in < :hristchurch. His Worship said, even assuming that accused had command over his horse, his absence from it was in itself a >>resch of the law; besides which, it was this kind of conduct that caused so many accidents. He would therefore be fined 10s. Obstructing a Thoroughfare. — Robert Macfarlane, grocer, High street, was charged «ith having wilfully obstructed the thoroughfare immediately in front of hia shop, by allowing hid horse and cart : to remain standng thereon. Constable Eares. proved that the horse was feeding out of a box, Accused, in defence, said he had been in the habit of U eding his horse in the same manner for the past twelve months, and not having been cautioned, bad no idea that he was doing *rong. His Worship said, if accused had roally been doing so for twelve months, he would get off very cheap with a fine of ss. Unregistered Dogs. — The following persons were each fined 20s for having unregistered dogs in their following, above the prescribed age : — James Bush, Archibald M'Kay, John Spencer, and James Potts. Sunday Liquor Selling.— W. R. Smith, landlord of the Crown Hotel, Montreal street south, was charged with having unlawfully ■ old liquors, and suffered the same to be <!runk upon his premises, during prohibited hours — to wit, Sunday the 2nd of October. Sergeant M'Knight said a Mrs Nelson had complained to him of her husband having been regularly drunk for some time past, and that he had been supplied with liquor by accused on the day named in the information. Sergeant I'ratt said, when he left the notice of complaint with prisoner, he admitted that a sick man had had a drink at the house on the Sunday morning during his (accused's) absence. Accused admitted this, but said, in •lefence, that he received no payment for jthe >!rink. John Nelson said he went to accused's house about seven o'clock in the morning of ihe day named, because he was ill, and obained a glass of lemonade and brandy. He •lid not have any more liquor at the house hat day. He got a bottle of spirits at an hotel, but not at accused's house. In reply to the Bench, witness declined to say where he got the spirits from. Accused, in defence, 'leaded that the drink was only given to Nelson medicinally, and- that he received no payment whateyer . for it, Nelson having no money. He had always been most careful in the conduct of his house, never even * eeping a light burning after the uroper time. Inspector Pender said that Mrs Nelson, when laying the information ugairist accused, said. her husband told her ontivtly that he had obtained the bottle of tspirits on the Sunday named from accused 'iim.=elf. His Worship said he was aware of ! hia, and asked if Mrs Nelson was in attendance. Inspector Pender repled in the i\3gative His Worship then said, as there was n 'thing before the Court to substantiate ihe charge, the ca?e would be dismissed, but he severely cautioned accused not to supply Irink in any shape or form on Sundays to the witness .Nelson. Accused promised. that he would not, and thanked the Bench for the leniency shown him. , . ,
