Some years ago, Mr Missing, a barrister on the Western Circuit, in defending a man charged with stealing an ass, took occasion to be somewhat severe on the plaintiff's counsel. The latter, after arguing his cause, concluded thus : — " One thing, gentlemen of the jury, is certain ; the ass was, and is, missing."
