(Before W Donnld, Esq., R.M.) House at Large. — J. Illingworth was> charged with having a horse at large on the sth ; fined 5s and costs. DutTsk ' and Incapable. — Thomas Jack was charged "with this offence. This being his third appearance within ( sjx, months, he was fined 20s, or four days' imprisonment. Breach of the Ltttelton Borough By-Laws. — John Rutledge, carter, was charged with this offence. John Hodgson, Inspector of Nuisances, said that from information he received on the 27th, he found that a quantity of damaged grain had been carted round the Sumner Road, from St David street to Sticking point ; there was a quantity on the road, in some parts half a bushel; at Sticking point there was a large quantity on the road. Defendant said other carts were emptying rubbish ; he did not know there was any liability ; he saw Dimond emptying rubbish there, it had been always the usual place ; he knew now there was a road, but it was dangerous, and if any accident happened to his horse in being compelled to go down it, he should make the Council pay. His Worship said he did not see how the information could be laid ; the leakage of bags in carting was not throwing rubbish. G. F. Scott said that the grain was carted round and shot in the usual place. By prosecutor : He knew there was another road. The Bench reserved its decision.
