WHAT IS A CONTRACT ? 1 An interesting point was decided by Mr Rawson, S.M., at Hamilton last Thursday, in a case under the Land Agents Act, , in which J. E. Hamell, agent, sued J. McGlorin, for £72 commission on exchange of defendant's property. The defence was that no written authority had been given as required by the Act, The Magistrate emphasised the distinction between a written appointment and a note or memorandum, as in the present case, and held that although the Act did not require any set form of words, or that an appointment of an engagement should be contained in one document, it did require an unequivocal written appointment of, or authority to an agent to dispose of the principal's property-that is to say that writing or writing" must constitute a contract of employment. The documents produced in this case did not amount to a written authority. He non-suited plain-, tiff, with costs.
