The -Tram way Company is in trouble again. In the District Court 'they have had an action brought against them this week because a passenger stepped off a tramcar into a hole and hurt himself. The liole was msde by the Company it will be understood, and the car stopped opposite to it. Once more the Company pleaded that the accident was the fault of the sufferer, and not of the Company. They said the car was stopped to take tip and let down passengers on the opposite side, and that the conductor had no idea the passenger who got hurt was going out at all. Had he known, he would hare warned him ot the danger. The defence was all very well, but the iury found the Company liable to pay £35---and costs. It seems rather hard on the Company at first, and yet the warning is a necessary one. Every passenger on a car has a right to get down when the car stops, and it is the duty of the conductor t© stop at places only when it is safe to do this. Of course if the danger had been quiteevident, the passenger, would have been mainly to blame, but the jury found that it vrae not so, and under the circumstances, they properly gave a verdict against the Company.
