MONDAY, FEBRUARY 20, 1922. (Before Mr J. H. Salmon, S.M.). THE EASIER WAY. For cycling on the footpath at Tararu Richard Barrett was fined 5s and costs. ASSAULT. Isaac Haley charged Jack Lynch with unlawfully assaulting Jiim at Waitakaruru on January 27. A plea of guilty under provocation was entered. Defendant was convicted and fined £1 and costs. He was allowed a fortnight in which to pay the amount. BROKEN. Thomas Murawai pleaded guilty to having failed to comply with the conditions of a probationary license. He was arrested in the Bay of Islands. Accused was convicted and fined £5 and costs £4 4s, in default two months imprisonment. DRUNKENNESS. ft A first offender did not appear to answer a charge of drunkenness. He was convicted and his bail was estreated. CIVIL CASES. In the following cases judgment with costs was given for plaintiffs by default: —J. H. Lange v. William Worthington £5 10s, A. and G. Price v. Henderson and Martin £44 18s lid, same v. Tibby and McDonald £25 17s lOd. STORE ACCOUNT.

Mrs. J. M. Wallace (Mr Parnell) claimed from M. Burnanz (Mr Clendon) the sum of £7, balance of an account alleged to be owing. Mrs. J. M. Wallace, formerly storekeeper at Kaihere, said that prior to May, 1920, .she had supplied stores to defendant and others. Afterwards the stores were charged to one man, covering all in the camp. The men were foreigners. Without paying the bill the camp dispersed. She had difficulty in tracing the men concerned. One Ivanovitch paid £2l and said that she would get the remainder. In camp accounts she entered the name of one man. To Mr Clendon: She had given a receipt for £2l. Three of the men undertook to get the balance paid by the fourth man in the party. The account was made out in the name of Dragovitch. George Ivanovitch said that Dragovitch got some goods. Later he said he would pay all but Dragovitch’is account. Plaintiff said she had a letter from Dragovitch and he would pay his share. Witness paid £2l.

Ivan Burnanz said- that he was working at Kaihere. At this time Dragovitch bought the goods and made the arrangements. Mrs. Dragoviteh ordered the goods. He had given authority to a mate to pay his share and later had paid his mate back.

The Magistrate said that the equity and good conscience clause should be given effect to. He would join the other parties and adjourn the case until March 15. The other parties would be served. Each party in the contract was liable for the amount. He took this course to enable the other men to see that the fourth man was served and so made to pay his share.
