A Contested Case. Geo. Elliots special site on Kaitoke special claim, Great Barrier. —This was objected to by the Kaitoke Gold and Silver Mining Company (no liability) on the following grounds :—(1) That the said proposed machine site is j situated upon the Kaitoke special claim, the property of the objector. (2) That the only suitable and prac- 1 lically available position or site upon j I the said Kaitoke special claim for the erection of a battery and crushing plant and machinery is the site and | area marked and applied for as aforesaid by the said Geo. Elliott. (3) That the said Kaitoke G. and S.M. Go. has ever since it purchased or acquired the said special claim, and the owners before it of such special claim have intended and proposed that such. site should be the position or place on which the said company shall erect its own battery, and such site is required inter alia by the said company for the said purpose. (4) The granting of such site to the said Geo. Elliot will materially prejudice, damage, and interfere with the mining operations of the said Kaitoke Gold and Silver Mining Company (no liability"). Mr Mahonoy appeared for the applicant and Mr Parr for the defendant Company. After three witnesses had been called by the applicant's solicitor and the latter had intimated that was all the evidence he intended to call to establish his case, His "Worship said he should then have to refuse the application as undoubtedly the applicants holding the license had a preferential right to the site. Mr Mahoney sought to show that the Company was acting in a " dog in the manger way," but Mr Parr repudiated this, saying they were willing to give any other available site for machinery. The application was thereupon refused with j costs £2 2s.

Pkospecting License, A. McLeod applied for a prospecting license at Hikutaia, but it was objected to by GK M. J. Gannon, as he had previously applied for a portion of the said area as the Hercules, i.e., No. 2, No. 3 special claims, and Hercules No. 4 licensed holding; also objected to by Geo. Alley on the ground that he had with the consent of the owner pegged and applied for the area under the names of Alley's Freehold and Alley's Freehold Nos. 2, j 3, 4, 5, 6, and 7 special claims, and applied fcr same in Paeroa Warden's j Court; also by Henry Alley on the j grounds: (1) That the Warden has no power or jurisdiction under section 2 j of the Mining Act 1891, Amendment Act 1896 to grant the said prospecting license. (2) That the said land is being, and has been for some time past, prospected for gold and silver with reasonable diligence, and that an average sum of not less than £1 per per acre is being expended in so doing. ! Arguments were made use of by [ Messrs Clendon on the one side and Jackson Palmer on the other, and eventually the case was adjourned to Paeroa.
