AN INTERESTING CASE,

At the Warden's Court to-day, before H. Eyre Kenny, Esq., WardeD, Kiohard Cox made application for the * JSoufbern Cjoss claim, 4 men's ground ft t Moanatairi Creek. ... Wn. Cruicksbank objected on the ground that he had pegged out the ground first. Eichard Cox deposed that on November 30th he marked out the ground as Stated in the application in accord- ■ luce with the regulations. Witness and Ibe other men mentioned had miners' rights. To Oiwckehank : Witness marked the pegs IXI. Witness marked no •trenches round the pegs. Witness drore the pegs into the soil. ;._ .. The Warden said that the witness /■xhad established a prima facie case, "'and the burden of the proof of his oase was now on Cruickehank. . William Cruickahank deposed that there were no pegs in the ground at ? 9 o'clock on the morning of December 3rd when witness pegged out. Witness Baw no traces of pegs having been put in. A difficulty then arose between the opposing parties as to the position of the ground, and each drew out a rough plan of the area he had pegged. After seeing the. plan made out by Cox, the Warden said that the applicant had admitted that he pegged in nearly all the ground in the old Calliope licensed holding, which comprised 8 aorea. This was more than the area applied for viz., four men's ground, and Moirdingly the application would be dismissed. , The Warden then heard the application of Wm.
