Tile Armed Forces Appeal Board continued its sitting in Timaru yesterday, when a large number of cases was dealt with. The Board comprises Messrs F. F. Reid, S.M. (chairman), A. H. McKane and G. M. Hall.

W. H. Lawton, manager of the Timaru Woollen Company, appealed on the grounds of public interest for John Andrew McMahon, described as assistant designer. Appellant said that McMahon had not desired to appeal. He was in a key position in the Timaru Woollen Mill, and his position could only be filled after training someone else over a long period. Mr Tracy said that appellant had had 16 months to replace the reservist and nothing had been done. He was being paid £6 a week to do work which a girl could do.

Appellant said that he could do the work that the reservist was doing, but the work of the mill would suffer.

The appeal was dismissed, reservist not to be called up before March 1. In the case of the appeal by Mrs M. E. Vucetich in respect of Geoffrey Vucetich, on the grounds of public interest and undue hardship, the appeal was dismissed, reservist not to be called up before March 1, 1942. M. O’Connell appealed for Maurice O’Connell on the grounds of public Interest and undue hardship. On the latter. ground the appeal was dismissed, and on the ground of public interest the appeal was dismissed, reservist to be transferred to the territorial forces.

An appeal by J. C. King, in respect of Kenneth Roland King was adjourned sine die, and an appeal by the Director of National Service in respect of William Moody King was dismissed, reservist not to be called up before January 1. Undue hardship was the ground of the appeal lodged by Mrs L. McAuley, of Gleniti, in respect of James Joseph McAuley. The appeal was adjourned sine die. Transfer Granted J. Paterson was appellant in respect of Robert John Paterson on the ground of public Interest. Appellant said that the reservist was his only son, and in addition to work on the farm, he did shearing for four or five neighbours. The appeal was adjourned sine die, reservist to be transferred to the territorial forces. J. E. P. Cameron appealed for John Arthur Preston Cameron, station manager, on the ground of public interest and undue hardship. It was dismissed on the ground of hardship and adjourned sine die on the ground of public interest. Leonard William Sargent, runholder, Mt. Studholme, appealed on the grounds of public interest and undue hardship. W. H. Sargent was coappellant, but his appeal was dismissed That of reservist was adjourned sine die.

Jerome Foohey appealed in respect o John Jerome Foohey on the grounds of public interest and undue hardship. According to a statement submitted by appellant, the son had run the farm for some time but received no payment. The chairman said that they had to consider the matter from the point of view of public interest, but it appeared that the farm was uneconomic. In his own interests, appellant sho\ ’.l acquaint the Board with his financial position. Later in the day a statement of appellant’s position was presented, and the Board then adjourned the appeal sine die.

Mrs B. Brosnan appealed in respect of Patrick Fergus Brosnan and the Director of National Service appealed In respect of John Joseph Brosnan. Mr W. H. Walton, who appeared for Mrs Brosnan, said that they were asking for time to enable P. F. Brosnan to dispose of 10 trotting horses and also to assist with the harvest. The appeal was dismissed, reservist not to be called un before March 31. and that in respect of J. J. Brosnan was adjourned sine die. The Court remarked that it was not concerned with the disposal of the trotters. They were prepared to allow anyone time to dispose of a business, but it should not take six months to dispose of the trotters.

J. Caird was the appellant in respect, of Frederick David Caird on the grounds of nublic Interest and undue hardship. = On the second ground the appeal was dismissed and on the first ground was adjourned sine die, reservist to be transferred to the territorial forces. Non-combatant Service Robert William George Tavener appealed on the grounds of conscientious objection against the bearing of arms. The chairman: You are an officer of the Salvation Army? Appellant: Not now. but I was. You are prepared to serve in a noncombatant capacity?—Yes. The appeal was di?"-’-sed, reservist to serve in a non-combatant capacity. Stuart Allen Rogers, farm contractor, appealed on the grounds of undue hardship and public interest. Questioned by Mr Tracv, appellant said that he was not aware that his mother had told the Board that she would not appeal, as she could carry on without appellant. Mr Tracy: How much income tax did you pay last year? Appellant: £B. That means that your taxable in come was £BO. yet your return to the Government shows your total income at £9O. Appellant: That is not right. Mr Tracy: They are your own figures. A petition was presented on behalf of 25 farmers asking that appellant be retained to carry on the contract harvesting. The appeal was adjourned sine die. H. W. Askin’s appeal on behalf of Harry Coningsby Askin was dismissed on the ground of public interest and adjourned sine die on the ground of hardship.

An adjournment until the next sitting of the Board in Timaru was made in the appeal of A. O. Gould on behalf of Gavin Shirley Thompson. A similar adjournment was made m respect of an appeal lodged for Harold Beveridge Paterson. Appellant stated that the reservist was a good man, and he wanted to keep him if possible. He had not made any attempt to replace him. The Board advised appellant to make some effort before the appeal was renewed.

V. G. Clarke appealed for Ewen Davies Hanna, the appeal being dismissed, reservist not to be called up before January 1 next. Conditionally on his accepting shearing work during the season, a reservist. Lewis Tozer, for whom W. Mann appealed, is not to be called up before February 1. No . evidence was submitted in the case of the appeal in respect of Norman Harold King, and the appeal was withdrawn.
