The Securities Exchange Commission in a final report on the Whitney failure, condemned the unwritten code of silence, permitting Whitney to continue in business and power, long after his misdeeds were known or suspected. The report stated that the Exchange’s stubborn indifference to public responsibility was starkly revealed by the testimony of Morgan’s partner, Lamont, who knew Whitney had misappropriated funds as early as November 27, 1937.
