APPEAL DISMISSED By Telegraph —Pres9 Association WELLINGTON, December 4. In the Appeal Court, the case of Wilton Collieries, Limited, v. Connew and others came up again. On September 20, the Court of Appeal heard argument in this matter concerning the operation of Section 17 (2) of the Workers Compensation Act, 1922, on an agreement between the Company and Connew, attempting to contract out of the Act. In delivering reserved judgment this , morning, the Court held that as Con- ? new had died since the proceedings; were instituted, there were no parties before the Court affected by the agreement, and therefore it should refuse to • give a general abstract interpretation of the section. The judgment of the lower Court on l the question was vacated, and the apv ; peal dismissed.
