IMPORTANT ACT HELD TO BE UNCONSTITUTIONAL United Press Association—By Electric Telegraph—Copyright (Received May 7, 5.5 p.m.) WASHINGTON, May 6. The entire Railroad Retirement Act, affecting more than a million employees, has been held by the Supreme Court of the United States to be unconstitutional. Legislation Involved. The railway retirement legislation provided for the creation of a pension fund, affecting over 1,000,000 railway workers, the railways to make compulsory contributions twice in excess of the workers’ contributions. The court’s majority report expressed the opinion that Congress had no right under the constitution to tax one class in such a manner for the benefit of another.
