Complaints of the inequitable operation of certain sections of the Land and Income Tax Act have been discussed by the Council of the New Zealand Society of Accountants. On the matter of the assessment of income in any one year—which involves the question of allowance of expenditure in the earning of incomeseveral members of the Council have urged that it would be to New Zealand’s advantage to come into line with English law in this matter, and thus the Dominion would have guidance in the decisions on cases heard in England. The Council has decided to support the opinion of a legal authority to whom this question has been referred. In the case of death duties it is complained that the charging of interest on the assessment involves grievous hardship in some estates, which may consist mainly of “frozen assets,” by reason of the unfavourable conditions for realisation. The Council has decided to take legal opinion as to the feasibility of framing suitable legislation for the avoidance of hardships, if the present law continues to operate inequitably.
