ALLEGATIONS OF PERJURY
INFORMATION NOT IN ORDER By Telegraph—Press Association AUCKLAND, July 26. A private prosecution alleging perjury in the hearing of a case last year against Robert William Campbell and his wife, Mary Campbell, who were found guilty of a serious offence, came before Mr Wyvern Wilson, S.M. The informant was Campbell, who is at present undergoing a sentence of imprisonment. He was represented by Mr Allan Moody. There were four informations alleging perjury, but two of these were dismissed for want of prosecution.
Mr Moody submitted that In respect of the remaining informations, they contained nothing to justify the placing of defendant upon trial. The Magistrate told counsel for the informant that he did not think the informations were in order. He added he had been asked to settle the form of the informations, bht the proper course was to submit them to learned counsel for consideration and not to the judiciary.
“Four or five or six offences are alleged in one information,” continued the Magistrate. “Each alleged offence should be in the form of a separate information.” The informations would be struck out because they were not in order. He was not able to allow costs to the defendant.
