ILLEGAL EXCLUSION OF MEMBER. By Telegraph—Press Association WELLINGTON, May 23. Reserved judgment was given to-day by Mr Justice Reed in the Supreme Court m the case in which William Henry Hargreaves sought assistance of the Court to obtain admission as a member of the Wellington Waterside Union and claimed £SO damages for wrongful deprivation of employment. The case raised the question of whether or not it was intra vires to provide by lules that in the unfettered discretion of the executive a person may be excluded from membership of the Union. His Honour’s conclusion was that the Union could not in law refuse to admit the plaintiff as a member and that the Union’s refusal had resulted in damage to the plaintiff. Judgment was given that the plaintiff became a member of the Union on December 16, 1933, and for a writ of mandamus to enrol the plaintiff also for £3O damages with costs, witnesses expenses and disbursements. His Honour said that he was not concerned with the question whether or not it was advisable to limit the number of members of the Union. What he had to determine was whether or not it could be done legally in the manner attempted.
