CLAIM FOR COMPENSATION FAILS By Telegraph—Press Association HOKITIKA, June 9. At a special sitting of the Supreme Cort to-day, Mr Justice Blair presiding a claim was heard of James Edwin Searle, of Mananui, for £1,029 damages, and compensation for partial loss of the sight of his right eye, caused hy being struck a tape from a starting barrier at the Westland races in December, 1931.
After a hearing lasting all day, His Honour stated that negligence by the defendant, Westland Racing Club, was not proved. Even if negligence had been proved, there was an onus on plaintiff who, with others at the starting post, was warned by the starter of the danger and told to keep clear of the starting apparatus. Judgment was given for defendant club, with costs.
