“JIMMY” WALKERS POSITION. United Press Association—By Electric Telegraph—'Copyright (Received October 7. 7.45 p.m.) NEW YORK, October 6. Litigation following the resignation of Mr James Walker, Mayor of New York, resulted in the decision of the Court of Appeal to-day that the new Mayor must be elected on November 8, at the same time as the national elections.

The New York City Democratic Convention to-night nominated as surrogate, Mr John P. O’Brien, who is the choice of Tammany Hall, over Mr James Walker, or Acting-Mayor McKee. This followed a bitter fight, involving national politics. At the last minute, Mr Walker, who is en route to New York, abroad the Europa. cabled the withdrawal of his name, partially because he is in ill-health, and partially because he desired to avoid any embarrassment to the national ticket, headed by Mr Franklin Roosevelt, whose friends at the Convention agreed to Mr O’Brien, but indicated that they would fight Mr James Walker, whose name brought thundering applause from 3200 delegates, causing the leaders to predict that he is likely to be a candidate at the 1933 elections.
