APPEAL COURT CASE. By Telegraph—Preiw Association WELLINGTON, March 20. The Court of Appeal is hearing the appeal of the New Zealand Redwood Forests Ltd. versus the New Zealand Insurance Co., Ltd., from a judgment of Mr Justice Smith. An originating summons was issued by the Insurance Company last November, stating that it was trustee for the debenture holders of the New Zealand Forests Ltd. Certain resolutions were passed by the majority of debenture holders, and the Insurance Company sought direction as to whether the resolutions were validly passed, and, if so, whether the Company should hand over the trust fund in the manner directed by the resolutions.
Mr Justice Smith held that the resolutions were not validly passed, and the Company as trustee, should hold the trust fund. The apnellants are anpeaflng both on flscfc and law.
