TINWALD FATALITY.

POINT MOTORIST ACQUITTED. By Telegraph—Pres* Association. ASHBURTON, August 22. At the Magistrate’s Court, Oswald Jones, of Pleasant Point, storekeeper, was charged with having negligently driven a car on the main south road at Tinwald, on July 5, thereby causing the death of George Morton Mackenzie. Deceased, a youth, was knocked down while cycling at night. The evidence was given on lines similar to that taken at the inquest on Mackenzie. Mr Tracy submitted that there was no evidence on which to convict. The Magistrate said he did not think a jury would convict and he did not propose to commit accused for trial. The evidence was consistent with a cyclist going out from behind a lorry to pass it and was struck by a car. The charge was dismissed.
