(Sn»~fnl to t-ho “> CHRISTCHURCH, April 8. A case in which a professional jockey claimed £3OO damages from a Riccarton horse trainer, for alleged defamation, was called in the Magistrate’s Court to-day. Douglas Cotton, of Christchurch (Mr Twyneham) proceeded against Frederick P. Claridge, of Riccarton (Mr Thomas) on a claim for £3OO damages. Subsequently it was announced that a settlement had been arrived at. Plaintiff, in his statement of claim, 1 said that he was a professional rider. On December 27, 1929, at Greymouth, the following conversation took place between plaintiff and defendant. Defendant said to plaintiff: “You pulled Thorndale when you rode him for me at Ashburton." To this statement i plaintiff replied: T did?” whereupon j defendant said: “Yes. you well j did.” Plaintiff then a?lced defendant ' if he (defendant) had told a client of I plaintiff's that he (plaintiff) had lost l his nerve. Defendant thereupon re- ! plied: “Yes, your nerve is gone.” Such l conversation, it was alleged, took place |in the presence of one Arthur S. Jones, of Timaru, and the words used Sby defendant were maliciously and i falsely spoken, and were published to I Arthur S. Jones. Defendant meant bv the words mentioned that plaintiff i had been guilty of fraudulent and disi honourable conduct, and that he was j unfit to follow his calling as a pro- ; Sessional rider. In consequence Oi uie j words plaintiff was injured in his I credit and reputation, and in his cal- ■ lin S as a professional rider. Plaintiff j claimed from defendant £3OO damages, i When the case was called before Mr i H - A - Young, S.M., Mr Thomas said i that the parties were just writing out ! the terms of settlement. ! The Magistrate ordered the case to i be held over until this afternoon, but j the parties met immediately aftsrI wards and a complete settlement was arrived at.
