GISBORNE, October 7. t Oil tbc ground char, the poll should have been taken of electors as a whole and not of ratepayers only, the second poll, which resulted' in the proposal to discontinue the Gisborne tramways, was upset bv Air Levvy, S.M., this morning. 'l'ho first pol! of the ratepayers was upset on a technical point and the second was taken last year, resulting m favour of the discontinuance of trams.
A second appeal was then lodged, and tlie decision on this was adjourned several months ago, pending a decision in a case believed to have been referred to the Court, of Appeal, but which it now transpires is not going forward. The riding of Mr Justice Herdmnn. therefore, stood, stated Air Levvy, that the pull should have, heoit on the general body of electors in this case, and therefore he must iiml that the poll being taken, of ratepayers only, was in vn I’d.
The Alngistrate allowed £6 6s costs to the petitioners.
