MAGISTRATE’S COURT.

TIMARU, MAY 9. (Before Mr E. D: Mosley, S.M.) A VAGRANT; S. Field, an elderly man, was charged with being an idle and disorderly person. Senior Sergeant Fahey said a complaint had been received from Kingsdown that a person had been seen sleeping round about hay stacks. A constablo was sent down and found accused sleeping out. His clothes were in a ragged condition and wet. He appeared weak of intellect, and looked a fit subject for the Old People’s Homo. His Worship said he could not commit the old man to the Home, except on the evidence of a medical officer of the Health Department; Accused was remanded for. a week in order that further inquiries could bo made; ARREARS IN MAINTENANCE; An elderly man, who was represented by Mr 8; B. Beaufoy, was charged with failing to comply with the terms of a maintenance order for the support of his wifo and children, and with being in arrears to the extent of £52: As the wife was residing in th 9 North Island, counsel for the defence asked that a remand, bo granted in order that further evidence could bo obtained;

Thomas Edward Bower pleaded guilty to a charge that, being a person released on probation under tlio Ofenders Probation Act, he did commit a breach of his liccnso in failing to report to tho Probation Officer. Senior Sergeant Fahey said accused had been released on probation on a charge of theft, and should have reported on April 1, but had failed to do so. Accused had been employed by n blacksmith in Tirnaru, and had left in thp absence of his employer. Mr W, J. Parkes, assistant Probation Officer, gave evidence as to arresting accused. Accused said he went to Dunedin on March 28 and oxnccted to return on tho following Monday. He met ono or two friends and they persuaded him to lomain longer. In the meantime he had snent his mono.v, but worked on the wharf at Port Chalmers, earning enough to return to Tirnaru. Hie assistant Probation Officer said accused had been in good employment, before bo loft Tirnaru. Accused had previously told his employer that he intended, going to his uncle’s place at Ma.kikihi, He had not done so, but had go’m to. Dunedin. His Worship said accused had also been lying, which did not look well in the face of two convictions for theft, and be was going to seo that tho of probation wore complied with-. Accused was convicted and sentenced to 80 days’ imprisonment.
