At the Tiinaru Magistrate’s Court yesterday a JJorough Council employee and a local contractor figured before Mr E. D. Mosley, S.M., as the leaders of opposing factions in an action, the latter being charged with having used insulting language in the hearing of passers-by, whereby a breach of the peace might have been occasioned, and with using obscene language. Mr Emslie appeared for the complainand and Mr W. I>. Campbell for defendant, who pleaded not' guilty. Mr Emslie stated that the complainant was borough foreman, and on the day in question he was sent to see if defendant was filling in certain trenches in a proper manner. When complainant did so he found that the work was not being done properly, and defendant came up, and, after some conversation, seemed to lose his temper and used the lniu'uage complained of. Mr Campbell stated that defendant did not deny using some language inwards complainant. He was angry at the time but lie denied the objectionable expressions complained of. The Magistrate stated that he was satisfied that defendant had used the language complained of, no doubt after losing his temper. The question of filling in the trench bad nothing to do with the matter. He would not enter up a conviction for using obscene language, but defendant would be convicted for using insulting language.
