A specially stated claim for compensation came before tile Arbitration Court a-t Wellington on Tuesday afternoon, iix the case of tlie Public Trustee m the estate of tlie late John M'AulifFe v. tlie Borough Council of Tomuka. The deceased had carried out tlie sanitary work of the horotifdii under an agreement, which provided for remuneration the annual Hum of £IOJ and i'or appliances a- tank cart. The deceased lia.d to provide tlie horse and the necessary tool 1; of trade. Hp was killed >Oll 2nd .January.. 1911. by nn extra express train passing throui/h Temuka in the early hours of tlie morning. At the timo he was driving home from work. Tho question before the court, over which Mr Justice Sim presided, with Messrs J. A. M'Cullough and W. Scoit as assessors, was whether tli-e deceased was a worker "within the moaning of tlie Act, and therefore his relatives and dependents were _ entitled to compensation. After heaving Mr .T. M. Macd'onald, on behalf of tho Public Trustee, argue length -on this point, tho court adjourned tlie case until further nolice, Mr \V. H. D. Roll appeared for the defendant borough counoil.
