It was contended oil behalf of the .Board, that the matter was one of contract, and the engagement expired by effluxion of time, and was not dismissal as was suggested. The Court held that the system of the Board was a breach of the Edu- ; cation Act and beyond the power and | authority of the Board, on the grounds : that by this system tho provisions :is to appeal and consultation of the committee*. upon the termination of the teacher's engagement, and the superannuation scheme, wEcli provisions are statutory rights conferred upon teachers and commitees, are ignored, and rendered, if the system is effective, inapplicable to teachers employed by the defendant Board.
