Magistrate said that the, analysis showed that the . wino was ordinary port, with the addition of one-ninth ot a grain of quinine to the fiuil bunco of wine. Defendant contended that; as a chemist he was expressly exempted from the Licensing Act regarding tho sale of liquor without a .license. The Magistrate held, that in- order- that defendant ■ should' come within the, exemption it must be clear that the wine was sold for medicinal, purposes. Molendo was sold at a. eomn"arutively low price of 3s a bottle and was a palatable beverage. It was,not supplied by the -doctor's, prescription,-.amK.up <£n T quiries were made at the time of sale as to the purnoso for which the wine was required.
