COURT OF APPEAL.
CONVICTION AFFIRMED. Per Press Association. WELLINGTON, August 12. Justices Cooper and Chapman this morning affirmed the conviction of exConstable W.'J. Gardner, bv Mr'Riddell, S.M., For assaulting Mr Rolfe in the street fracas in May last. Constables Watson and Gardner were implicated, but there was a doubt as to the identity of Mrs Rolfe's assailant. Mr and' Mrs Rolfe saw Watson, but failed to identify him. The Magistrate concluded from the other evidence that Gardner was the assailant, and sentenced him to twenty-one days' imprisonment. Gardner apnealed, but the conviction was affirmed with £lO 10s costs.
