Mr Millar moved to amend the clause in the direction of requiring the Council, instead of the Commissioner, to notify failure to agree at the end of one month" and requiring aijset&ors io make separate recommendations. The motion was agreed to. Clauses 39, 41 and 42, which had. been struck out- by the Labour Bills' Comniittee, •were reinstated at. the instance of the Minister. Considerable discussion took place on clause 45, as to the number of men ncoessarv to form a union. Ihe 'Minister said the increase from seven to fifteen, would not prejudice more than half a dozen unions. He objected to duplication of unictns, simply for the benefit of two or three men. The clause was retained oh. a division by 47 votes to 20. At clause 47, some discussion took place on the voting powers of unions, some members thinking "one nian one vote" should apply. Eventually a motion to amend the clause was defeated by 45 votes to 19, and the clause passed. . Clauses 48 to 56 passed with minor amendments. . Clause 57, the needs and exertions wage clause, as taken out. by the Labour Bills Committee, was struck out. At clause 58, Mr Barclay moved an amendment in the direction of making it! compulsory for the court to make awards. Strong exception was taken to th<i recent, behaviour of the court in refusing to make awards. It was pointed out that the Court Bad been dictating to Parliament what legislation it should pass. It was for the Court, to obey the intentions of Parliament, and Parliament Bad decreed that the Court must, regulate industry. That was the reason why the Court- was established. The Hon. Mr Millar said that judges in other Courts had the right to dismiss cases and nonsuit plainiiifs, and he wished it to be distinctly recognised that the Court of Arbitration had a similar discretion. - v Several members protested, against the Court stultifying Parliament, and dvlilkrratcly \evaifing its tintie?.
