COMMON OR PRIVATE CAR RIERS.

CHBISTCHURCH, August 10. B. Pitcaithly and Co., owners of the coastal steamer John Anderson, trading between Lyttelfcon and the bays of Bank's Peninsula, were sued.-by John B. Thacker for £25 to-day as damages for refusing to take him toiOkain's Bay and for unlawfully setting Mm ashore again at Lytteltoa.
The statement' for plaintiff was that ,the { captain acting on iwfcruetMns had demanded '< SI for the passage to Okab's Bay while ; others on the sacoe trip had, teen charged '' ss. \\Plaintiff.;refused .to" pay and' the 1 steamer'-was turned" hack and he was •set; ashore. 1 : ".-The .^ast;Whether -flte'de- ' carriers, whether; they;liad : .the "rig-It "to refuse -a .passag* .to a'. Tes'pe'ctsble person rtble to" pay- for -it- and whether they'were : entitled to: cha'rge-jan' unreasonable fare", .- ' The defence was that "the scale of fares, had been raised before the occurrence; no one bad actually been required to pay increased fare but the shipmaster had been instructed to give concessions even to a. passage for nothing to those persons who sent their produce as cargo in the firm's vessels. The firm claimed a legal right to discriminate as to who should be required to pay the full amount of the fare.
