■» TlMAßU— Wednesday, January 16th. (Before His Honour Judge Ward.) TN BANKRUPTCY. Jeremiah Costigan was called for public examination ; Mr J. W. White appearing for the assignee m bankruptcy, and Mr Raymond for the bankrupt. Costigan was examined by Mr White principally as to giving the bill of sale to T. Wells over stock" m the tobacconist's shop, and over the racehorse Sunrise and a trotting mare. He did not strike a balance sheet previous to giving the bill of sale, did. not clearly know his position at the time, but expected to pull through all right. With the money lie got from Wells he went to the Christchurch races, but did not give the bill of sale for the purpose of being able to go, though he admitted that the greater part of the money went m gambling and betting transactions at Christchurch. Bankrupt was confronted by one item of £10, which he had sworn at his examination before the assignee had gone as a bet to one Daniel McGarry. The tobacco got from Miles and Co. was procured by his employee, m his absence at Christchurch, at the time he was owing the firm other moneys. Had purchased the horses from William Moore. Did not drive Moore to St. Andrew's on the day he absconded; Moore drove witness down. In addition to carrying on the busidess of a tobacconist, carried on the occupation of a bookmaker ; did not make money at this ; lost on the whole. This closed the principal part of the examination. j Mr Raymond, for the bankrupt, remarked that he had already been tried and convicted for charges which arose under the bankruptcy. In the case of John Richmond, a bankrupt, Mr White appeared m support of an application that the bankrupt should . show cause why he should not be committed for contempt for not paying, as directed by the court, the sum of £30, proceeds of wool sold, to the Official Assignee. Mr Raymond appeared for Richmond. His Honour after hearing lengthy argument, dismissed the summons without costs. PROBATE. His Honour granted orders m probate as follows :— Adam Mclntosh, deceased, late of Timaru, farmer, application made by Messrs Perry, Perry and Kinnerney ; James Jones, deceased, stonemason, Timaru, by Messrs Perry, Perry and Kinnerney ; John Cuthbert, deceased, no occupation, Timaru, by Mr Raymond. Letters of administration were granted as follows \--.Re James Stevenson, deceased, contractor, Opihi . (Mr Raymond) ; Thomas Rainey, deceased, labourer, Winchesser (Mr Hay for Mr Aspinall). On the application of Mr Raymond, on the part of Mr Moore, solicitor, Palmerston North, an order was granted admitting the affidavit of Mrs Wells, m re Thomas Rennett, deceased, late of Timaru, subject to filing m the Supreme Court.
