SUPREME COURT.
(By Telegraph.; NEW PLYMOUTH, Oct. 17. The first witness this morning was William Sole, butoher, who deposed that he saw accused at 11 o'clock on the morning of the day of the murder, at 20 minutes after Boon and at three o'clock. Accused and some other natives were m a room at the back of the shop where ho made up small goods which he only did on Friday. Accused did odd jobs about the back of the chop and slaughter bouse for him. In cross-examina-tion witness said he told the polico he expected Mala Eai at bis shop on Friday and that he was there during the morning. He denied saying that he did not see accused till 3 o'clockSole was very severoly cross-examined by Mr Fell, but the witness maintained that he had consistently given the same version of the affair as now, and he told tho police that he knew of Kai's movements on the day the murder was committed. Albert Briscoe corroborated Sole's evidence us to llahi Eai being m Sole's butcher's shop between eleven and twelve o'clock on the Friday when Maloney was murdered. In cross examination he denied telling the polioa that he had changed his mind as to the time when he saw the accused. At 2 p.m. other witnesses to prove an alibi were calledAlbert Briscoe, slaughterman, stated that he saw Mahi Eai on Friday April lltb, at 11 o'clock m Bole's shop m Devon street. Accused was working m Sole's shop about a quarter of an hour. Witnsss saw accused agnin about 12 o'clock. (The object of the evidence is \to comradict tho theory of the prosooation, viz.. that accused murdered Maloney between 11 and 12 noon of 11th April last.) In cross-examination witness denied having told Inipeotor Pardy that th» first time he saw accused on the 11th April was at 4 p m. David Fawcett also gave evidence to the effect that be saw the accused m Devon street between 12 30 and 1 p.m. Three Maori witnesses swore that they saw Mahi Kai between 11 and 12 o'clock m Devon street. R. Jacklyn gave evidence to the >ams effect. The court adjourned tiU to to-morrow.
