TIMABU, Satpbday, Oct. 3bd. (Before His Honor Judge Ward.) His Honor took hia seat at 11 a.m. CIVIL CASE. Muds Hanoen v. James Sanderson— Claim £140. Mr C. T. H. Perry, of Messrs Perry and Perry, for plaintiff; Mr J. W. White, of Messrs White, Smitbson and Baymond, for defendant. This case was resumed on Saturday mornin?, Mr White continuing his address for the defence. Mr White reyiowed tho o*idenco given by hia client's witnesses at great length, and, comparing it with that given by plaintiff and for plaintiff, said it contradicted most of the material points relied on by plaintiff. In concluding Mr Wbito said the cose hingod entirely on the question was tho mortgage obtained by fraud or misrepresentation ? He confidently submitted it had not, aa he hud aliown during his address, that Hanson waa quite awaro of what ho was doing when he entered into the transaction. I mitted failed to prove this the' whole action had failed also. Before resuming his seat I Mr White quoted from Kerr on Fraud, m support of his contention. Air Perry aiked, and was allowed by H'ib Honor to postpone his address till Monday at 11 o'clock, and thß Court at 1.45 p.m. adjourned.
